Children law (private)

The welfare of children following a relationship breakdown is paramount. Our family team has expertise in advising separating parties on residence and contact arrangements for children, and in representing parties making applications for a Child Arrangements Order (including FHDRA and DRA hearings, fact finding hearings and final hearings). These cases are fundamentally important to children and their parents, and we approach them in an empathetic but realistic and practical manner.

We deal with claims for maintenance on behalf of children, and can advise on enforcement of financial awards and settlements in order to ensure that our clients receive their entitlement. We are also able to advise clients on a range of other orders including Prohibited Steps Orders; Specific Issue Orders; Occupation Orders and Transfers of Tenancy and to represent them at issue resolution hearings. We regularly represent clients in fact finding hearings involving allegations of domestic abuse; sexual violence, emotional and psychological abuse.

We advise on applications for custody and internal and external relocation. Many of our barristers have experience in dealing with cases with an international element where there may be a risk of child abduction. We are also experienced at dealing with cases where there is an application for a child to enter the UK, working with immigration specialists if required.
